This is a rumor that's been around for a while. That property is located in the CP-3 zoning and the maximum height is three stories (35 feet). A high-rise cannot be built on that property.
All land development plans that have been submitted are listed on our website at http://www.statecollegepa.us/3030/Projects-Land-Developments .
Once a land development plan is submitted, the review will go before the Design Review Board and Planning Commission two times (once for a preliminary plan, and once for a final plan). These are all public meetings that offer opportunities for the public to speak.

After talking with our Ordinance Enforcement Division, I was able to acquire some information that could be helpful. It's the tenant's responsibility, prior to signing any leases to review the property and note any defects within the property. Again, we recommend documenting any of these defects and working with the landlord to ensure they're noted in the lease agreement. If this was all noted as part of the lease agreement then you would need to file a civil case.
